Terms of Service
The agreement between your business and ScryOS, Inc. for using Dispute Daddy.
These terms are an agreement between you (the business that signs up, and anyone acting for it) and ScryOS, Inc. (“ScryOS”, “we”, “us”), which provides Dispute Daddy. By creating an account or using the service, you agree to them.
1. The service
Dispute Daddy helps businesses respond to chargebacks and payment disputes. You upload your records; the software organizes them, checks them against dispute requirements, flags gaps and inconsistencies, drafts a response packet for your review, and tracks deadlines and outcomes.
- We don’t submit responses for you. You review, edit and approve every packet, and you submit it to your payment processor, card issuer or lender yourself.
- We don’t connect to your payment processor.
- We aren’t a law firm, and we don’t give legal advice.
2. No guarantee of outcome
Card issuers, networks, processors and lenders decide disputes, not us. We don’t guarantee that any dispute will be won, reversed or recovered. “Win chance” and similar indicators are guides based on your evidence, not promises. Preparing, approving or submitting a response doesn’t mean money will be recovered.
3. Your responsibilities
- Deadlines. Meet the response deadline on your dispute notice. The due date your processor gives you always governs, even if the app shows a reminder or a different date.
- Accuracy. Make sure what you upload and submit is accurate and complete, and that you have the right to share it. Don’t submit anything false or altered.
- Personal information. Upload only the personal or health information a dispute needs.
- Account security. Keep your account secure and tell us promptly at support@disputedaddy.ai about any unauthorized use.
- Lawful use. Use the service only for your own legitimate disputes and in line with the law, your merchant agreements and card-network rules.
4. Health information
If you are a HIPAA covered entity, our Business Associate Agreement applies to protected health information you upload. You accept it at sign-up, and it forms part of these terms. If these terms and the Business Associate Agreement conflict about protected health information, the Business Associate Agreement controls.
5. Subscription, billing and cancellation
- Price. Dispute Daddy costs $99 per month per workspace, plus applicable taxes. There is no percentage of recoveries and no success fee.
- Billing. The subscription renews automatically each month and is charged through Stripe to your card on file until you cancel.
- Cancellation. You can cancel anytime from billing settings in the app. Cancelling stops future charges. There is no cancellation or exit fee.
- Refunds. Fees already paid are non-refundable, except where the law requires otherwise.
- Price changes. We will give at least 30 days’ notice before a price change takes effect.
6. Your data
You own your records and the packets you create. You give us permission to process them only to provide and secure the service for you, as described in our Privacy Policy. We don’t use your records to train models for other customers, and we don’t sell them. You can export your data and delete your workspace.
7. Acceptable use
Don’t misuse or interfere with the service, attempt to access other workspaces, reverse-engineer it except as the law permits, use it to create false evidence, or resell it without our written permission.
8. Our intellectual property
The software, the Dispute Daddy method, templates and content belong to ScryOS. These terms don’t transfer them to you, apart from your right to use the service while you subscribe and to keep the packets you create.
9. Availability and changes
We work to keep the service available, but it may sometimes be interrupted for maintenance or reasons beyond our control. We may improve or change features. If we remove a core feature you are paying for, we will tell you in advance.
10. Disclaimers
The service is provided “as is.” To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost chargeback amounts, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. These limits don’t apply to either party’s breach of its confidentiality or data-protection obligations, or to your obligations under section 12.
12. Indemnity
You will defend and indemnify ScryOS against third-party claims arising from content you upload or submit, or from your breach of these terms.
13. Termination
You may stop using the service and cancel anytime. We may suspend or end access for a serious breach of these terms, non-payment, or to protect the service or others; where reasonable, we will give notice and a chance to fix the problem first. After termination you can export your data for 30 days unless you deleted it first.
14. General
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Delaware. We will post changes to these terms and notify customers of material changes before they take effect. These terms, the Privacy Policy and, where applicable, the Business Associate Agreement are the entire agreement.
